I further acknowledge that I am aware that the Activities will be conducted in facilities open to the public during the Activities. I further agree and warrant that if, at any time, I believe conditions to be unsafe, I will immediately discontinue further participation in the Activities.

2.     I fully understand that: (a) the Activities involve risks and dangers of serious bodily injury, including permanent disability, blindness, paralysis and death (“Risks”); (b) these Risks may be caused by my own actions, or inactions, the actions or inactions of others participating in the Activities, the conditions in which the Activities take place or the negligence of the Releasees (defined below); (c) there may be other risks and social and economic losses either not known to me or not readily foreseeable at this time; and (d) I fully accept and assume all such risks and all responsibilities for losses, costs, and damages incurred as a result of my participation in the Activities.

3.     I hereby release, discharge, covenant not to sue, and agree to hold harmless Go Mammoth, it’s owner(s), administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors and advertisers, and, if applicable, owners and lessors of premises on which the Activities take place (each considered to be one of the “Releasees” herein) from all liability, claims, demands, losses, or damages on account caused or alleged to be caused in whole or in part by the negligence of the Releasees or otherwise, including rescue operations, and further agree that if, despite this release, I, or anyone on my behalf, makes a claim against any of the Releasees named above.

I WILL INDEMNIFY, SAVE AND HOLD HARMLESS EACH OF THE RELEASEES FROM ANY LITIGATION EXPENSES, LOSS, LIABILITY, DAMAGES OR COSTS ANY MAY INCUR AS THE RESULT OF ANY SUCH CLAIM. I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE  SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THAT THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.

NOTHING IN THESE TERMS AND CONDITIONS SHALL LIMIT OR EXCLUDE THE LIABILITY OF THE RELEASEES FOR ANY DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE.

THESE TERMS AND CONDITIONS SHALL BE GOVERNED BY AND INTERPRETED IN ACCORDANCE WITH ENGLISH LAW AND ALL PARTIES SUBMIT TO THE EXCLUSIVE JURISDICTION OF THE ENGLISH COURTS.

1. Membership Term and Fees
1.1. Your membership will start the day you register and pay for your membership, unless otherwise specified during sign up.
1.2. Membership Fees are payable every month in advance by recurring card payments unless terminated in accordance with clause 3.
1.3. We reserve the right to increase the membership fees from time to time. You will be given 10 days prior written notice of such increases and should you decide not to accept such increases you may cancel your membership by notifying us in writing before the new fee rate commences.
1.4. Multi Class Membership:
1.4.1. As an Multi Class member, you may attend unlimited classes each week and you are guaranteed a place in your Primary class each week.
1.4.2. To ensure bookings accurately reflect class attendance, and to keep as many open spaces as possible, you can book into up to 3 classes at any one time. Once a session has passed, you will be able to book into another class.
1.5. Single Membership:
1.5.1. As a Single Class member, you may attend one class a week.
1.5.2. Your Primary class is the class you are automatically booked into every week, and you are guaranteed a place in this class.
1.5.3. You can change this class either temporarily or permanently at any time online by going to your login and clicking on the My Classes tab on your control panel.
1.5.4. If you cannot make a class, please swap out of the class into a class you can make. If you don’t swap your booked class before its start time, you will not be able to book another class that week.

2. Trial Period
2.1. All new members are granted a 5 day trial period, whereby members may cancel their membership within 5 days of their start date to receive a full refund on their first month’s membership.
2.2. Upon request of cancellation, their membership will be terminated with immediate effect.

3. Cancelling Membership
3.1. To cancel a membership, members must complete an online cancellation form a minimum of 5 working days in advance of their next payment date. A cancellation form can be requested from GO Mammoth by calling 0207 381 6034 or by emailing memberships@gomammoth.co.uk. Any other forms of notification will not be accepted.
3.2. Subject to termination or cancellation, no refund will be made in respect of the part of the relevant month falling after the date of termination.

4. Freezing Memberships
4.1. Members can freeze their membership for a minimum of 2 weeks, and a maximum of 4 weeks.
4.2. A minimum of one weeks notice must be given, along with appropriate supporting documentation, ie; a screenshot of holiday flights or doctors note etc.
4.3. Upon confirmation of the freeze, members will receive a refund equal to the period missed.

5. Failed Payments
5.1. If you fail to pay any amount due under this agreement for a period of more than 30 days, then we may pass the debt to a third party company for collection. The cost of this instruction will be borne by you, including costs in tracing you should you have changed address.

6. Missed Classes
6.1. As memberships are broken down into monthly payments, GO Mammoth will not compensate members who do not show up to sessions they have paid for.

7. Class Timetable
7.1. Occasionally due to reasons beyond our control, our timetable is subject to last minute changes. In every situation, we will endeavour to notify you as far in advance as possible.
7.2. We reserve the right to cancel classes up to the class start time, whereby all members booked into that class will be notified and their booking removed.
7.3. We cannot freeze memberships or refund for classes cancelled, and members are encouraged to book in to an alternative class.

8. Public Holidays
8.1. GO Mammoth do not run classes on Public Holidays and members are encouraged to book into an alternative class that week.
8.2. Over the Christmas period (usually the last 2 weeks of the year), GO Mammoth don’t run any classes. Your membership will be put on hold for that period and you won’t be charged.

Payments

Teams and Individuals can pay for a league using one of the following:

Team Payments

You register a team by following the registration process for Teams. The Team Organiser/Captain will pay for their whole Team and recover the costs from their players individually. We request that you pay at the same time you register your team in order to secure your position in the league (by following the registration process to the end). We will hold your team’s place in the league until 10pm the following day after you registered. If we do not receive full payment for your team by 10pm the followig day, your team’s position in the league will automatically be offered to the next team (either on the waiting list or re-marketed as spots available in the league). You can log-in to your control panel on the GO Mammoth website at any time, select MY STATEMENT, and process your payment.

The only exception to the above is if you have opted to pay by “bank transfer” – in which case, we allow 3 days for the payment to clear from the day you register. After which point, if funds are not received, will offer your team’s place to the next team.

 

Individual Payments

You register your interest in playing by following the registration process for Individuals. If there is a space available in a team for the league you selected, we will request that you pay the individual registration fee to confirm your position in the team. We will hold this place in the team until 10pm the following day after you registered. If payment is not received by 10pm the followig day, your place will automatically be offered to the next individual who registers. You can log-in to your control panel on the GO Mammoth website at any time, select MY STATEMENT, and process your payment. Alternatively, you can click the “Pay Now” link in the confirmation email you receive immediately upon completing your registration.

IMPORTANT: Your position in a league (whether a team or individual) IS ONLY CONFRIMED once your full league fees have been received by GO Mammoth.

 

Refunds

No refunds within 5 days of the originally posted start date of the league or class (no matter the circumstances – which includes but is not limited to illness and injury). For ALL refunds processed before this time, there will be a £15 processing fee for Individuals and a £30 processing fee for Teams.

ALL SOCIAL EVENTS/PARTIES/OUTINGS ARE NON-REFUNDABLE, NO MATTER THE CIRCUMSTANCES.

Booking Terms and Conditions

We accept bookings subject to the following conditions:

All holidays and trips on our website are subject to the following conditions:

1.  Reservation & Payment

For standard bookings, a non-refundable deposit of £50 per person is required. All bookings will be confirmed by Go Mammoth in writing to the lead passenger along with confirmation of balance payment details. The trip balance for all bookings will be required 30 days prior to the departure date of the trip; if there is a failure to complete the payment Go Mammoth reserves the right to cancel the reservation.

2.  Validity

Dates, itineraries and prices are valid from the most relevant edition of the website. Go Mammoth reserves the right to change any of the facilities, services, prices, itineraries or vehicles described in the brochure or online without being liable for compensation or refund.

3.  Cancellation by the Passenger

Cancellations must be made by the passenger in writing to Go Mammoth prior to the trip departure to be confirmed as cancelled. Cancellations within the balance payment period (60-0 days prior to departure) are as follows:

  • 60 days or more prior to departure, deposit to be retained by Go Mammoth
  • 59-30 days 70% of trip cost fee is forfeited
  • 29-15 days 85% of trip cost is forfeited
  • 14-0 days 100% of trip cost is forfeited

4.  Cancellation by Go Mammoth

Go Mammoth reserves the right to cancel a trip in any circumstances but will not cancel a trip less than 30 days before departure, except for Force Majeure, Low Bookings or the Client’s failure to pay the final balance. Unless the Client fails to pay the final balance, Go Mammoth will, upon cancellation, return all monies paid excluding payment for travel insurance or offer an alternative trip of comparable standard (does not cover the flight ticket or any other item which is not related with the trip operator Go Mammoth). No compensation will be paid to the Client if cancellation is because of Force Majeure or Low Bookings.

5.  Changes by the Passenger

All changes, amendments or additions must be confirmed prior to 60 days of the departure date to avoid cancellation or amendment fees. No new passengers may be added to a booking once completed.

a) Name changes requested within;

  • 60-30 days of departure will be free of charge;
  • 29-15 days of departure will incur an amendment fee of £15 per person;
  • 14 days of departure will be made at the sole discretion of Go Mammoth.

6.  Changes by Go Mammoth

Go Mammoth’s aim is to operate all trips as advertised accepts that it may prove necessary or advisable to vary or modify a trip itinerary or its contents due to prevailing local conditions or any other reason. Go Mammoth reserves the right at any time to cancel or change any of the facilities, services or prices described in our brochure or online and to substitute alternative arrangements of comparable monetary value or charge a supplement locally if alternative arrangements cannot be made, without compensation to the Client and accepts no liability to the Client whatsoever for costs or loss of enjoyment as a result of these changes. Where a major change is made prior to departure, the Client will have the choice of either: accepting another trip of equivalent or superior standard; or a choice of specific travel arrangements of a lower standard to those previously booked together with a refund of the difference in price; or cancelling the trip and obtaining a full refund. The definition of the “major change” is a change that is reasonably required but will depend on the individual trip and circumstances.

Provided that the major change, prior to departure is because of “Force Majeure” or “Low Bookings” (see below) compensation will be limited to £50, per person travelling. “Force Majeure” includes war, threat of war, riot, civil strife, terrorist activity, natural or nuclear disaster, fire or adverse weather conditions, technical or maintenance problems with transport, closures or congestion at airports or ports, or other similar events beyond the control of the Company. “Low Bookings” is where the minimum number of passengers to run a trip and make it viable, as set out in Go Mammoth’s documentation, is not achieved. Please note that the prices detailed in Go Mammoth’s brochures or on the website may be subject to change, for reasons beyond the control of the Go Mammoth.

7.  Travel Insurance

The passenger accepts that the cost of the trip does not include insurance & it is mandatory that all passengers obtain travel insurance while travelling with Go Mammoth covering personal injury, medical, repatriation, and evacuation expenses. Passengers must be able to provide proof of adequate insurance cover purchased if requested by the group leader or Go Mammoth representative. It is strongly recommended the coverage be extended to include cancellation, curtailment, and all other expenses that might arise as a result of loss, damage, injury, delay or inconvenience occurring to the passenger. Go Mammoth will not accept liability for loss, theft of, or damage to baggage or personal effects. Personal belongings lost or stolen while unattended by the passenger in public lounges or other public areas, whether on board a vessel, train, bus, or other mode of transportation, publicly owned or operated by Go Mammoth or elsewhere, are not reimbursable. Losses due to ordinary wear and tear or acts of God are not reimbursable. Go Mammoth will not accept responsibility for, and in no event shall be liable for loss or damage of valuables or other articles left in or on facilities used by the Go Mammoth such as hotels, vessels, expedition vehicles, or any other mode of transportation. When obtaining travel insurance the passenger must ensure the insurer is aware of the type of travel to be undertaken.

8.  Itinerary Changes

It may be necessary, sometimes at short notice, to make changes to an itinerary due to weather, traffic or road conditions. Regrettably, coaches, trains, boats do occasionally break down, or suffer mechanical or technical problems, or certain facilities on board a coach, train, boat may become faulty. Every effort will be made to rectify such issues as quickly as possible. In some instances it may be necessary to replace the vehicle or boat which cannot be repaired. We cannot accept any responsibility for delays caused by any form of breakdown.

9.  Complaints

In the event of any dissatisfaction with any service provided by Go Mammoth, You must report it immediately to the Trip Leader so that action can be taken to remedy the problem. Failure to notify the Trip Leader of any problem immediately may prejudice Go Mammoth and may result in your ability to claim compensation from us being extinguished or reduced. Any complaint made to Go Mammoth following the conclusion of the trip should be made in writing within 28 days of completion of the trip. In the event that you do not notify us in writing within 28 days, Go Mammoth’s ability to investigate the complaint may be prejudiced and may extinguish your claim.

10. Visas & Travel Documentation

It is passenger’s responsibility to obtain any visas, passports, health certificates or other travel documentation required. It remains the passenger’s responsibility to ensure that these documents are in order and meet any additional costs incurred as a result of failure to comply with such requirements.

11. Inclusions

The trip price and the local payment include:

  • All accommodation as listed in the Trip Inclusions Section
  • All transport listed in the Trip Inclusions Section
  • Sight-seeing and meals as listed in the Trip Inclusions Section
  • The services of a group leader as described in the Trip Inclusions Section

12. Exclusions

The trip price does not include:

Flights, excess baggage, visas, insurance, extra meals and drinks, items of personal nature, entrance fees, tips, port taxes & fuel supplements, departure taxes, optional activities and all the other services not stated in the trip details online.

13. Authority on Trip

Group trips are led by a Go Mammoth trip guide or trip leader. The decision of the group leader is final on all matters likely to affect the safety or well-being of any person participating in the trip. Should a passenger fail to comply with a decision made by the group leader, or interfere with the safety or well-being of the group, the group leader may order the passenger to leave the trip immediately, with no right of refund. Passengers must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and also agree to travel in accordance with our responsible travel guidelines.

14. Special Offers & Discounts

Special offers and discounts can only be applied at the time of booking and can not be retrospectively added at a later date, regardless of any later changes made to the original booking. Additional terms & conditions can be added during special campaigns and are solely valid for the specific campaign they refer to. Please see the Go Mammoth website for particular conditions applicable to each offer. In all cases only one discount can apply to a Go Mammoth Trip booking. When two or more offers can apply to a booking in all cases only the discount offering the highest saving to the booking will be applied.

15. Solo Passengers

All prices are based on double, twin or triple share occupancy (unless stated otherwise). Solo passengers not wishing to pay a single supplement will be accommodated in a double, twin or triple room according to availability with a passenger(s) of the same gender. The single supplement need only be paid if a room to oneself is requested and the single supplement must be paid in addition to the trip fee.

16. Age & Health

Passengers under 18 years old are not permitted on Go Mammoth trips. Bookings from persons under 18 will not be accepted in any case. All passengers are expected to be certain that prior to travel that they are fit and able to complete the itinerary of their chosen trip as described in this brochure or online.

17. Unused Services

Should a passenger fail to join a trip, joins the trip after departure, or leaves the trip prior to completion, no refund will be made.

18. Privacy Policy

In order to process your booking, Go Mammoth need to collect certain personal details from you. These details will usually include the names and addresses of party members, credit/debit or other payment details and special requirements such as those relating to any disability or medical condition that may affect the holiday arrangements. We take full responsibility for ensuring that proper security measures are in place to protect your information.

We must pass some information on to the relevant suppliers of your travel arrangements (hotels, transport companies etc.). Such suppliers may be outside continental Europe if your holiday is to take place or involve suppliers outside these countries. The information may also be provided to security or credit checking companies, public authorities such as customs/immigration if required by them, or as required by law.

Except where expressly permitted by the Data Protection Act 1998, Go Mammoth will only deal with the personal details you give to Go Mammoth as set out above unless you agree otherwise. We may make contact with you or members of your holiday party by post, email, or telephone for the purposes set out. We will also use your information to inform you of offers in the future. If you do not wish to receive such approaches in the future then please let us know as soon as possible by telephone, letter or e-mail us at hello@gomammoth.co.uk. If we do contact you by email about our updated website or special offers, you will also be able to unsubscribe yourself from our database at this time.

When the passenger submits the review form they accept that the feedback and all rights therein, become the sole property of Go Mammoth and that Go Mammoth shall have the right to make it available to the public on this website and for any purpose and in any media (including for advertising or other commercial use).

19.Photos & Marketing

The passenger consents to Go Mammoth using images taken of the passenger during the trip for advertising and promotional purposes in any media we choose. The passenger grants Go Mammoth a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes.

20. Responsibility of Go Mammoth

The trips operated or supplied by Go Mammoth have been designed to provide participants with an exposure to the true nature of the environment visited and therefore involve an element of potential risk and exposure to potential hazards over and above those associated with normal ’package’ holidays. All bookings are accepted on the understanding that the Client appreciates such risks and hazards and they undertake all trips at their own volition. If a Client participates in an activity not included as part of a trip operated by Go Mammoth, the Client accepts all responsibility for taking part in such an activity, accepts that no further services will be provided by the company and indemnifies Go Mammoth against any and all claims related to such an activity. Where the Client suffers death, personal injury or any other loss whatsoever as a result of an activity forming part of the trip arrangements booked with Go Mammoth, than Go Mammoth shall only accept responsibility if the death, personal injury or loss was caused by the negligent acts and/or omissions of Go Mammoth’s  employees, officers, agents or direct suppliers. For the avoidance of doubt, Go Mammoth shall not be liable for such death, personal injury or any other loss suffered whatsoever if there has been no fault on the part of Go Mammoth or its partners, or if the cause was the fault of the Client (including without limiting the generality of the foregoing the Client’s participation in any activity/option not specifically detailed as included on the trip or operated directly by Go Mammoth) or due to the actions of someone unconnected with the trip arrangements or due to circumstances which neither Go Mammoth nor its partners could have reasonably anticipated or avoided.

22. Governing Law

The terms & conditions (incorporating these Booking Conditions) and all matters arising from it, is subject to English Law and the exclusive jurisdiction of the English Courts.
